Pilotify Beta Program Terms of Service

1. Beta Disclaimer

This service is provided as-is during the beta pilot phase. By accessing or using Pilotify during the beta period, you acknowledge and agree that:

  • Experimental Nature: Pilotify is currently in beta testing. The service may contain bugs, errors, or incomplete features.
  • Subject to Changes: We reserve the right to modify, update, or discontinue any feature, functionality, or aspect of the service at any time without notice.
  • No Warranty: The service is provided without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
  • Feedback-Driven: Beta users provide feedback that shapes the product. Your participation helps us improve Pilotify for future releases.

2. Acceptable Use

During the beta pilot phase, you agree to use Pilotify in accordance with the following guidelines:

  • Testing Purpose: Use the service primarily for testing and evaluation purposes.
  • No Critical Data: Do not rely on Pilotify for mission-critical business operations or storing sensitive/production data during the beta.
  • Responsible Use: Do not attempt to:
    • Exploit security vulnerabilities or bypass authentication
    • Upload malicious code, viruses, or harmful content
    • Engage in activities that interfere with the proper functioning of the service
    • Use the service for any illegal purpose
  • Feedback Participation: We encourage beta users to provide constructive feedback, report bugs, and suggest improvements through designated channels.

3. Data Handling

Pilotify handles customer data during the beta period as follows:

  • Data Collection: We collect and process data necessary to provide the beta service, including account information, usage data, and content you upload.
  • Data Storage: Data stored during beta may be subject to less robust backup and recovery procedures than production systems.
  • Data Backups: You are responsible for backing up your own data during the beta period. We recommend not storing critical or irreplaceable data in the beta environment.
  • Data Deletion: Upon beta termination or your request, we may delete your beta account and associated data within a reasonable timeframe.
  • Privacy: Our Privacy Policy (available separately) describes how we collect, use, and protect your personal information.

4. Liability Limitation

CRITICAL: PLEASE READ THIS SECTION CAREFULLY

During the beta pilot phase:

  • No Liability for Data Loss: Pilotify shall not be liable for any data loss, data corruption, or data inaccessibility that may occur during the beta period. This includes, but is not limited to, accidental deletion, system failures, or any other cause.
  • As-Is Basis: The service is provided "as-is" without any representations or warranties of any kind.
  • Limitation of Liability: To the maximum extent permitted by law, Pilotify shall not be liable for:
    • Any indirect, incidental, special, consequential, or punitive damages
    • Loss of profits, revenue, business opportunities, or anticipated savings
    • Any loss of data or information
    • Any costs of procuring substitute services
  • Indemnification: You agree to indemnify and hold harmless Pilotify from any claims, damages, losses, or expenses arising from your use of the beta service.

5. Service Availability

During the beta pilot phase:

  • No SLA: There is no Service Level Agreement (SLA) guaranteeing uptime, response times, or availability.
  • Downtime: The service may experience planned maintenance, unplanned outages, or temporary unavailability without prior notice.
  • Feature Changes: Features may be added, modified, or removed without notice.
  • Capacity Limits: We reserve the right to impose usage limits or throttle access at our discretion.

6. Intellectual Property

  • Ownership: Pilotify and all intellectual property rights therein remain the exclusive property of Pilotify and its licensors.
  • User Content: You retain ownership of any content you upload to Pilotify. By uploading content, you grant us a license to use it solely for providing the beta service.
  • Feedback: Any feedback, suggestions, bug reports, or ideas you provide regarding Pilotify become our property without compensation or restriction.
  • Restrictions: You may not copy, modify, distribute, sell, or lease any part of Pilotify without our prior written consent.

7. Termination

Pilotify reserves the right to terminate or suspend your access to the beta service at any time, with or without cause, including but not limited to:

  • Violation of these Terms of Service
  • Non-payment of any fees (if applicable)
  • Discontinuation of the beta program
  • Any reason deemed necessary for the security or operation of the service

Upon termination:

  • Your access to the beta service will be immediately suspended
  • We may delete your account and associated data
  • Any provisions that by their nature should survive termination shall remain in effect

You may also discontinue your participation in the beta at any time by contacting us or ceasing to use the service.

8. Changes to Terms

During the beta pilot phase, we may update these Terms of Service at any time without prior notice. Changes will be effective upon posting to our website or notification through the service.

Your continued use of Pilotify after any such changes constitutes acceptance of the new terms. If you do not agree to the updated terms, you must stop using the service.

We encourage beta users to review these terms periodically to stay informed of any modifications.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these terms or your use of the beta service shall be subject to the exclusive jurisdiction of the courts in Finland.

By using Pilotify during the beta period, you acknowledge that:

  4. You will not hold Pilotify liable for any damages arising from your use of the beta service
  5. You will maintain appropriate backups of any data you consider important
